1. Acceptance of Terms
By accessing or using the PleaseCheckOnMe service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
2. Description of Service
PleaseCheckOnMe is a wellness check-in service that sends scheduled SMS messages to subscribers and notifies designated contacts ("Trusted Contacts") if the subscriber fails to respond after configured retry attempts. The Service is designed to provide peace of mind but is NOT an emergency response service.
3. Eligibility
You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Account Registration
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Subscription and Billing
- The Service is offered on a subscription basis with monthly or annual billing options.
- A 14-day free trial is available for new subscribers.
- Subscription fees are billed in advance on a recurring basis.
- You may cancel your subscription at any time; service will continue until the end of the current billing period.
- We reserve the right to change pricing with 30 days' notice to existing subscribers.
6. User Responsibilities
As a user of the Service, you agree to:
- Provide accurate contact information for yourself and your Trusted Contacts
- Obtain consent from individuals before adding them as Trusted Contacts
- Respond to check-ins in a timely manner when possible
- Use the Temporary Suspension feature when you know you'll be unavailable
- Not use the Service for any unlawful purpose
- Not abuse or misuse the Service in ways that could harm others
7. Trusted Contact Consent
All Trusted Contacts must opt-in via SMS before they can receive notifications. By adding a Trusted Contact, you represent that you have a legitimate relationship with that person and believe they would want to be notified about your wellbeing.
8. SMS Terms & Conditions
PleaseCheckOnMe offers an SMS-based wellness check-in program. By providing your phone number and consenting to receive SMS messages, you agree to the following:
- Program Description: You will receive automated SMS messages for scheduled check-ins, missed check-in alerts, and service notifications.
- Message Frequency: Message frequency varies based on your check-in schedule. Typically 1–3 messages per day.
- Costs: Message and data rates may apply. Check with your mobile carrier for details.
- Opt-Out: You can opt out at any time by replying STOP to any message. You will receive a confirmation message and no further messages will be sent.
- Help: For help, reply HELP to any message or contact [email protected].
- Supported Carriers: Major US carriers are supported, including AT&T, Verizon, T-Mobile, Sprint, and others. Service may not be available on all carriers.
- Consent: Consent to receive SMS messages is not a condition of purchase. You may use the Service without SMS by contacting support for alternative notification options.
- Privacy: Your phone number and SMS opt-in data will not be shared with third parties for marketing purposes. See our Privacy Policy for full details on how we handle your data.
How We Collect SMS Consent
PleaseCheckOnMe collects SMS consent through two methods:
Method 1: Web Registration Opt-In
SMS consent is optional and is never a condition of using PleaseCheckOnMe. Subscribers choose how they receive check-ins — by SMS, by email, or both — and may register and use the service entirely by email without granting SMS consent.
During account registration at pleasecheckonme.com/register, the SMS consent checkbox is not pre-selected and defaults to unchecked. Registration can be completed with the box left unchecked; a user who leaves it unchecked simply receives their check-ins by email instead. When a user does opt in, the consent checkbox displays the following exact text:

The registration form has three steps: (1) Plan Selection, (2) Account Information (where the optional SMS consent checkbox above is displayed), and (3) Payment. Users provide a phone number and may optionally check the SMS consent box in Step 2; those who prefer email check-ins leave it unchecked and proceed. The "SMS Terms" link points to this page (pleasecheckonme.com/terms#sms-terms) and the "Privacy Policy" link points to our Privacy Policy.
Method 2: Trusted Contact SMS Opt-In
When a subscriber adds a Trusted Contact (emergency contact), the Trusted Contact receives a single consent-request SMS. The message contains the exact text below:

PleaseCheckOnMe: [Subscriber Name] has added you as an emergency contact. Reply YES to confirm, or tap [consent link] to accept. You will not receive further messages unless you opt in. Msg frequency varies. Msg & data rates may apply. Reply STOP to opt out, HELP for help.
Trusted Contacts opt in either by replying YES to the SMS or by tapping the consent link in the message. Trusted Contacts who do not opt in receive no further messages from PleaseCheckOnMe. If a Trusted Contact does not respond to the initial consent request, the subscriber may request that one reminder be sent; the reminder uses the same wording, prefixed with "PleaseCheckOnMe Reminder:". Trusted Contacts can opt out at any time by replying STOP.
9. Service Limitations
IMPORTANT: PleaseCheckOnMe is NOT an emergency service. We do not:
- Dispatch emergency responders
- Monitor real-time location
- Provide medical advice or assistance
- Guarantee message delivery (dependent on carrier networks)
- Replace 911 or other emergency services
If you or someone you know is in immediate danger, please contact 911 or your local emergency services directly.
10. Service Availability
While we strive for 99.9% uptime, we cannot guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, carrier outages, or circumstances beyond our control.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
12. Intellectual Property
The Service and its original content, features, and functionality are owned by PleaseCheckOnMe and are protected by international copyright, trademark, and other intellectual property laws.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLEASECHECKONME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
15. Indemnification
You agree to indemnify and hold harmless PleaseCheckOnMe and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
16. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
